INTRODUCING MUNICIPAL WARD DELIMITATION PROCESS

Local Government: Municipal Structures Act, 1998 (Act 117 of 1998)

The Structures Act of 1998 provides the framework for the ward delimitation process. The Minister for Cooperative Governance and Traditional Affairs must determine a formula for the determination of the number of councillors (sec 20) before the commencement of ward delimitation. The formula is published in a Government Gazette.

The MEC responsible for local government in a province, using the formula determined by the Minister must determine the number of councillors for all municipalities in the respective province. The number of councillors must be published in Provincial Gazettes.

The MDB must delimit wards for all qualifying metropolitan and local municipalities, and must take into account certain legal provisions and criteria as set out in Schedule 1 of the Municipal Structures Act.

On receipt of the published number of councillors, the MDB calculates the number of wards for all municipalities that qualifies to have wards and the following steps are undertaken:

<!     ·     Ward size tables are developed showing the number of registered voters, number of wards, the norm, maximum and minimum number of registered voters per ward in each municipality.

<!     ·      The MDB prepares a set of draft wards. Drafts wards are prepared in loco with technical municipal planning and GIS officials. Draft maps are to be utilised for stakeholders and public consultation purposes.

<![   ·  Public and stakeholder consultation meetings are conducted in all municipalities qualifying to have wards. All stakeholders including citizens are given an opportunity to make proposals on how their wards should be configured.

<!    ·  The MDB must publish its delimitation of wards in Provincial Gazettes. The MDB must allow 14 days for any person aggrieved by a delimitation to submit written objections to the MDB.
